Efektivitas Mekanisme Pemanggilan Pihak Berperkara dengan Surat Panggilan Tercatat (POS) dalam Persidangan Perdata di Pengadilan Negeri Ungaran
Abstract
The summoning of parties in civil court proceedings is a crucial stage to fulfill civil procedural law. Supreme Court Regulation (Perma) No. 7 of 2022, which amends Perma No. 1 of 2019, regulates the electronic summoning mechanism. However, the Supreme Court subsequently delegated the summoning mechanism to all courts in Indonesia through registered mail (POS). This study aims to analyze the effectiveness of the registered mail summoning mechanism at the Ungaran District Court. The research method used is normative juridical, with a statutory approach and a case study at the Ungaran District Court Class I B. The findings indicate that the registered mail summoning mechanism still faces challenges, particularly delays, uncertainty in receipt by the summoned parties, and potential maladministration. Therefore, further evaluation is needed to assess the effectiveness of this mechanism to support the principles of fast, simple, and low-cost justice.
