Perlindungan Tenaga Kerja di Indonesia dalam Penanaman Modal Asing Setelah Undang-Undang Cipta Kerja (Studi Kasus PT Gunbaster Nickel Industry)

Abstract

Investment is seen as one of the most effective ways to speed up a country's development, and labor is one of the factors that needs to be considered when implementing foreign investment in Indonesia, both Indonesian and foreign labor, in the context of technology transfer. This is reflected in development policies as outlined in the national development plan for the 2025-2029 period, which targets three main national development goals: reducing poverty levels, improving human resource quality, and achieving high and sustainable economic growth. The achievement of these targets is measured by several indicators, including reducing the poverty rate to 4.5-5 percent, achieving a human capital index (HCI) of 0.59 percent, and achieving economic growth of 8 percent by 2029. However, in its implementation, labor protection and freedom of association without discrimination are needed in relation to foreign workers employed in Indonesia under the Foreign Investment in Indonesia program. Based on research findings, policies regarding the placement of Indonesian and foreign workers have not consistently adhered to existing regulations. This could lead to jealousy between Indonesian and foreign workers. To address the issue of Indonesian and foreign workers in foreign investment in Indonesia, policies are needed that can provide opportunities and at the same time protect Indonesian workers in occupying certain positions that are the same as those of foreign workers in foreign investment companies in Indonesia.
